Maridadi Travel – Terms and Conditions

Please read these Terms and Conditions carefully as they constitute a legally binding agreement between you (the “Client”) and Maridadi Travel (the “Company”), a tour operator registered in Tanzania. By booking a tour or service with Maridadi Travel, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Privacy and Data Protection:

We are committed to protecting your privacy and handling your personal data in accordance with our privacy policy. By using our website and contacting us via provided channels, you consent to the collection, use, and disclosure of your personal information as described in our privacy policy.

2. Modification of our Terms & Conditions:

We reserve the right to modify and/or update our terms and conditions at any time. Any changes will be effective immediately upon posting them on our website [Link to your website’s terms and conditions page]. By continuing to use our services after such changes, you agree to be bound by the modified terms. Clients with existing bookings will be notified of significant revisions.

3. Intellectual Property:

The content, logos, trademarks, and other intellectual property on our website are owned by or licensed to Maridadi Travel and are protected by applicable intellectual property laws. You may not use, reproduce, modify, distribute, or display any of our intellectual property without our prior written consent.

4. Prices:

  • All prices are quoted per person (unless otherwise stated) in [Specify Currency, e.g., USD] and are subject to change without prior notice until a booking is confirmed.
  • Prices include services as specified in the tour itinerary. Additional costs, such as flights, visas, vaccinations, optional excursions, personal expenses (souvenirs, drinks, laundry), and gratuities, are not included unless explicitly stated.
  • Discount rates for children or peak-season surcharges are not automatically included and will be specified in your personalized quotation.
  • Prices published on our website should be used as a guideline only. Maridadi Travel will provide actual costs in its quotation proposals. Quotations are valid for [Specify timeframe, e.g., 14 days] and are subject to change based on overall travel package modifications.
  • Maridadi Travel reserves the right to levy surcharges due to factors beyond our control, including but not limited to increases in transportation costs (fuel, airfares, taxes), park fees, reserve fees, concession fees, or unfavorable exchange rates. Clients will be informed of such surcharges prior to final payment, and if exceeding 10% of the total price, clients may cancel with a full refund.

5. Booking, Payments, and Cancellations:

  • 5.1 Booking Confirmation: Upon receiving your inquiry, we will send you a detailed itinerary outlining destinations, activities, and accommodations. Your booking is confirmed only upon your written acceptance of the proposed itinerary and receipt of the specified non-refundable deposit.
  • 5.2 Payment: We require a [Specify percentage]% deposit of the total itinerary cost within [Specify number] days of invoice receipt. Bookings made within [Specify number] days of departure require full upfront payment. We cannot guarantee bookings if payments are delayed. Full payment is due no later than [Specify number] days before the departure date. Failure to make full payment may result in cancellation and forfeiture of the deposit. The lead booker is responsible for full payment for the entire group.
  • 5.3 Cancellations and/or Refunds:
    • 5.3.1 Cancellation by the Client: Cancellation must be in writing and incurs the following charges based on the total tour cost
      • NON-REFUNDABLE if cancelled between 0-61 days before departure.
      • 100% REFUNDABLE if cancelled less than 61+ days before departure or no-show.
    • 5.3.2 Cancellation by Maridadi Travel: While we strive to avoid cancellations, we reserve the right to cancel for reasons including non-payment or if the minimum number of participants is not met (with notification provided within specified deadlines based on trip length). In cases of cancellation by Maridadi Travel (excluding force majeure), you will receive a full refund of monies paid. We are not liable for consequential losses.

6. Modifications:

  • 6.1 By the Client: Amendments to confirmed bookings are subject to availability and may incur additional charges. Errors in booking confirmations must be reported within 7 days to avoid fees. Changes to itinerary, activities, or accommodations requested more than 14 days before departure may be treated as a cancellation of the original service with applicable fees and the cost of the new service. Changes to arrival dates may be possible with administrative fees and subject to service availability. Traveler replacements are possible up to 20 days before departure with administrative fees and subject to the new traveler meeting all conditions. Modifications within [Specify number] days of departure may be treated as cancellations.
  • 6.2 By Maridadi Travel: While unlikely, we reserve the right to make changes to your holiday. Minor changes will be communicated. Major changes (significant alterations to flights, accommodations, or activities, not due to force majeure or airline changes) will offer you the option to accept the change, choose an alternative holiday, claim a price reduction, or terminate the agreement with a full refund. No additional compensation will be provided. We are not liable for changes or cancellations due to unforeseen circumstances beyond our control or your failure to comply with booking conditions.

7. Insurances:

Comprehensive travel and medical insurance is mandatory for all travelers, covering medical expenses, repatriation, and optional coverage for cancellation, curtailment, emergency evacuation, and loss of personal belongings. Proof of insurance may be required.

8. Medical Conditions and Disabilities:

Clients must inform us of any medical conditions or disabilities that may affect their holiday at the time of booking. We reserve the right to decline bookings if we cannot adequately accommodate specific needs.

9. Travel Documents:

Clients are responsible for ensuring valid passports, visas, and vaccination documents are held for all countries visited. We provide general information but it is your responsibility to verify requirements with relevant authorities.

10. Carriers:

Air and sea travel is subject to the terms and conditions of the carriers and international conventions. We are not liable for cancellations, strikes, timetable changes, technical issues unrelated to us, lost luggage, rescheduling costs, or delays resulting from carrier decisions, even if we booked the tickets. Our liability for damages is limited to three times the travel sum.

11. Risks:

You acknowledge that participation in our tours involves inherent risks associated with wilderness, environment, health, transport, and personal safety. Standards may not be the same as in developed countries. You agree to take reasonable measures for your safety and we are not liable for harm resulting from failure to follow safety recommendations.

12. Limitations of Liability:

Our responsibility is limited to ensuring your holiday is executed as described and services reach a reasonable local standard. We are not liable for services not part of our contract, including those arranged directly by hotels or other suppliers. Our liability for activities and services not part of our contract is limited to our role as booking agents. Our overall liability for damages is limited to three times the travel sum, and we are not liable for failures due to your actions, unavoidable circumstances, or third parties not engaged by us.

13. Problems During Your Trip:

Any issues encountered during your holiday must be promptly reported to the service provider (e.g., hotel manager, guide) for resolution. If the problem cannot be resolved on-site, comprehensive written details must be submitted to us within 28 days of your return. Failure to do so may limit our liability.

14. Local Laws and Regulations:

You must adhere to all applicable local laws and regulations of tours, carriers, and accommodations throughout your trip.

15. Definitions:

  • Force Majeure: Unforeseeable and unavoidable events beyond our or our suppliers’ control, including war, civil unrest, natural disasters, epidemics, technical transport problems, flight cancellations, and similar events.
  • Minor Change: A modification that would not significantly impact your confirmed holiday based on the information provided during booking.

16. Translation of the Terms and Conditions:

These Terms and Conditions are originally stated in English. In case of discrepancies in translations, the English version shall prevail.

17. Contract:

Your contract is with Maridadi Travel. By making a booking, you (the lead client and all members of your group) agree to these Terms and Conditions. A package travel agreement exists between you and Maridadi Travel upon booking confirmation. Minors are not allowed to make bookings.

18. Jurisdiction:

These Terms and Conditions shall be governed by and construed in accordance with the laws of Tanzania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tanzania.
